Product Licence Agreement

All products of BIVROST TECHONOLOGIES Company Limited (referred to below as Bivrost), including but not limited to software, hardware devices and documentation, together with all future orders, are governed by this agreement. If you are unwilling to accept these terms, contact customer service within 3 days of receiving the product for a refund. We will refund the purchase price, less shipping and a reasonable handling fee.

1. Permitted Use

You may use this product in the ways described in the documentation Bivrost provides, such as the product manual and the commissioning guide.

You may send commands to the product to perform the corresponding functions by calling the interfaces given in the communication protocol document Bivrost provides.

For additional customisation requirements, or for uses that fall outside the scope of the licence granted here, contact Bivrost before purchasing the product. Bivrost will assess each request on its merits and reply as to whether it can be implemented and what assistance can be offered.

2. Prohibited Use

Except as expressly permitted in Section 1, you may not copy, reverse-engineer, disassemble, decompile, modify, add to or enhance the software, the hardware or any other part of the product. Reverse-engineering any part of the software or the product, or attempting to derive the source code of the software, is prohibited. Installing or running any software not supplied by Bivrost on the hardware device is prohibited. Distributing the software on magnetic or optical media, or over a network, is prohibited.

3. Limited Warranty

Bivrost warrants that, for 12 months from the date the product is delivered and under normal conditions of use, the hardware will be free from material defects in workmanship and materials, and the software will be free from material faults.

4. Limitation of Remedies

When a claim is made under this agreement, Bivrost will provide free replacement or repair of the hardware and remote assistance to repair the software. Shipping and insurance must be prepaid when the product is returned to Bivrost or to a Bivrost authorised dealer.

Other than the warranty given in this agreement, Bivrost makes no further express or implied warranty and accepts no further liability for the products described in this agreement, including their quality, their performance and their fitness for any particular purpose.

5. Limitation of Liability

Whatever the cause, and whether arising under the provisions of a contract or from criminal matters, including negligence, where you or any other party suffers a loss caused by our product, or where the product is the cause of the action or is indirectly related to it, the total liability of Bivrost to you and to any other party shall not exceed the purchase price you paid for the product. Under no circumstances is Bivrost liable for losses arising from your failure to meet your obligations, for loss of data, profits or savings, or for any other consequential or incidental loss, even if Bivrost has been advised of the possibility of such loss, nor for any claim you bring on the basis of a third party’s claim.

6. Termination

If you fail to comply with the terms set out in this agreement, your licence and this agreement will be terminated. However, Sections 2, 3, 4 and 5 remain in effect.
